1. Agreement
These Terms govern Mademory, provided by Individual Entrepreneur GLEB KUCHERENKO. By using the app, the user accepts these Terms and Apple’s Standard Licensed Application End User License Agreement. Mandatory law and mandatory Apple terms prevail where applicable.
2. Adult authority
The app is intended for an adult authorized to preserve and share information about a child. The user is responsible for permissions covering added content, invited participants and export destinations.
3. Content ownership
Users retain rights in the content they add. The operator does not claim ownership of artwork, photographs, audio, recognized text or metadata. The app receives only the technical permissions required for chosen features.
4. Plans
Free permits creation of up to 20 top-level local works and one new child profile. Local Pro is a one-time purchase for unlimited local creation and premium local features. Family & Cloud is a monthly or annual auto-renewable subscription for unlimited creation and available iCloud sync and sharing while active.
The App Store display immediately before purchase controls price, currency, period and offer. Availability may depend on device, iOS version, region and Apple services.
5. Subscriptions
Payment is charged to the Apple Account at confirmation. A subscription renews automatically unless cancelled at least 24 hours before the current period ends, subject to Apple’s current rules. Apple handles renewal, cancellation, refunds and billing.
Apple Purchase Family Sharing is separate from inviting people to an iCloud archive. Local Pro is not Family Shareable.
6. Expiration and cancellation
Ending Family & Cloud pauses new subscription-only cloud writes, sharing and other gated creation actions under current product rules. It does not delete or hide existing local content or block playback, OCR search, export or restoration of the user’s backup.
7. Backups, sync and data safety
iCloud synchronization is not a verified independent backup. Users are responsible for creating, protecting and retaining backups. A protected `.mademory` file requires its passphrase, which the operator cannot recover.
No software can guarantee perfect crop or OCR results, uninterrupted availability, zero data loss or compatibility with every future platform version.
8. Acceptable use
The app may not be used unlawfully, without authority over content, to violate privacy or intellectual-property rights, bypass purchases or security, interfere with Apple services, distribute a prohibited modified app, or exploit, harm or surveil another person.
9. Apple services
StoreKit, iCloud, CloudKit, system sharing and other Apple frameworks are operated by Apple. Their availability and behavior are outside the operator’s control and remain subject to Apple’s terms.
10. Changes and availability
Features may be improved, changed or discontinued where law permits. Material changes to paid functionality will be communicated as required. These Terms may be updated with a new effective date and legally required notice.
11. Disclaimer and liability
To the fullest extent permitted by law, the app is provided “as is” and “as available.” Nothing excludes non-waivable consumer rights. Liability is governed by the applicable law of Georgia and mandatory consumer protections in the user’s country.
12. Governing law and contact
